This online shop, www.bataille.online (hereinafter referred to as “Website”), is operated by Bataille GmbH, domiciled at Sihlquai 131 (Hub Zürich), 8005 Zürich, Switzerland (hereinafter referred to as “Bataille” or “we”) managing directors: Alexander Lamm & Julian Jäggi, email@example.com. Bataille offers high-quality fashion items, free shipping worldwide.
All orders placed on this Website are subject solely and exclusively to the Terms and Conditions of Business set out in the following and as applicable at the time the order is placed.
The prices of all the products on the Website are inclusive of all applicable taxes as well as customs and handling charges. Payment can be carried out with all major credit cards (we use Stripe) or using Apple Pay or Pay Pal. The currencies in which payment is possible are CHF (Swiss Franc), EUR€ (Euro) or USD$ (US Dollar).
PLACING AN ORDER The customer can start the ordering process for the desired item(s) by clicking on the cart (round purple circle) and proceeding to checkout. After entering the relevant information in the order form and choosing the preferred payment method, the order is placed by clicking on the button „Place Order“. The order will be confirmed by an auto-generated email.
DISCLAIMER Theorder confirmation does not yet constitute the sale contract and likewise does not imply acceptance of the order on our part. We have the right to refuse any order at our own discrection and without giving any explanation.
CANCELLATION As long as the order has not entered the shipping process yet, the order or single items thereof can easily be cancelled without cost implications by sending an e-mail to firstname.lastname@example.org.
CONCLUSION OF SALE CONTRACT Once the ordered goods have been dispatched, the sale contract between the customer and Bataille is in force, and the order cannot be cancelled anymore. The dispatch of the ordered goods means that the sale contract is therefore concluded in Zürich, Switzerland, and accordingly the default language of the contract is German. The dispatch of the order will be advised by email.
The order is usually shipped on the day of the order or the following day. The parcel is shipped either directly from Switzerland or from our warehouse in Germany. The parcel will be delivered by DHL or UPS worldwide within few days. If several products have been ordered at the same time, the products may be dispatched in several shipments and may arrive at different times. The customer will be notified accordingly and given the Tracking Number(s) to monitor and manage the delivery or deliveries. Every delivery requires signature of the customer or his/her proxy (a person with power of authority). Any potential transport risks are borne by Bataille.
Deliveries to countries outside Switzerland and the European Union (EU) are sent as DDP – Delivered Duty Paid, i.e. the recipient does not bear any costs for the delivery of the goods and does not have to pay any taxes upon the receipt of the goods. In countries where DDP deliveries are not possible, e.g. Russia, the customer has to pay the import fees upon delivery of the parcel. But the amount paid will be refunded by us. In this case, please send a scan of the receipt of the paid amount to email@example.com. Please note the section on returns though.
UNCLAIMED PARCELS If the parcel remains unclaimed and is hence returned, the customer bears the cost of the second attempt at delivery. If a second delivery is not requested by the customer, the full shipping costs plus effective customs and taxes that were levied shall be borne by the customer and are subsequently deducted from the refund. In case of unclaimed and hence returned parcels, the transport risk of the return dispatch is borne by the customer also.

Any item can be returned for whatever reasons and for full refund within 2 weeks.
RETURN PROCEDURE The 2-week-time window for returns starts on the day the parcel is delivered. The goods must therefore be back in our possession within two weeks of this date for a valid refund. The procedure for returns is as follows: Notification to Bataille must be made about the desired return by sending an email to firstname.lastname@example.org. Then, the customer receives the return confirmation along with the return slip for print out. Bataille arranges for the pick-up of the parcel. The customer will be advised accordingly and reminded to keep the parcel ready for pick-up by the courier. The invoiced amount will only be reimbursed after the goods are back in the possession of Bataille and have passed muster.
PROVISO Product returns are only eligible for non-faulty, unworn, unaltered, unwashed goods that are in their original condition and original packaging, and with all original tags still attached.Bataille reserves the right to refuse to take back goods if said conditions for returns are not met. Every customer is expected to handle the received product(s) with ample care when unpacking and examining it/them. If the product(s) has/have suffered deterioration in value on account of having been worn, washed, damaged, or if the labels have been removed, the customer must compensate Bataille accordingly. The compensation may amount to up to 100 % of the purchase price depending on the extent of value deterioration. Of course negligible deterioration resulting from simply inspecting and trying on the items in a correct manner as is possible and customary in a retail shop or department store must not be compensated for.
RETURN COSTS If a complete order is returned, the customer bears the return shipment costs! If the order contains several items, if only 1 item remains unreturned, the customer bears no return shipment costs. In other words, if the customer orders several products, keeps 1 and sends the other one or the other ones back, return is free!
Returns can only be accepted from the country which the shipment was sent to. The money will be refunded within 30 days onto the same means of payment used for the order. Potential losses due to currency fluctuations will not be refunded.
Charge of import costs for returns from countries outside Switzerland and the European Union (EU): For returns from countries outside Switzerland and the European Union (EU), the import costs (taxes and duties) of the returned product(s), paid by us in the first place, shall be borne by the customer and will be deducted from the refund.
If an ordered item is defective, we apologize and exchange the item at our expense. Requests for exchange must be made within 2 weeks of receipt of the order by email to email@example.com. The grounds on which the exchange is requested must be reasonable and stated in the email. The Bataille products are presented on the Website in the form of digital photographs of the actual products. Minor discrepancies between the presentation and the actual products do not qualify as a defect in the goods ordered.
All intellectual property rights in any content of the Website (including text, graphics, software, photographs and other images, videos, sound, trade marks and logos) are owned by Bataille GmbH. Except as expressly set out here, nothing in these terms and conditions gives you any rights in respect of any intellectual property owned by us and you acknowledge that you do not acquire any ownership rights by downloading content from the Website.
The privacy of everyone visiting our website is strictly respected and all personal data protected.
When you visit the website we will use some data about your use of the website (data on how you came to the website, the date and time of your visit, data on pages visited and products searched for, page response times, length of visits etc.). Our use of this data is necessary to ensure that the service we provide is accurate and to continuously improve the website.
All customer data provided to us for the purpose of placing an order or creating a user account (last name, first name, e-mail address, address, place of residence, phone number) will be recorded and stored by Bataille solely and exclusively for the purpose of processing the order. No personal data will be kept any longer than necessary and no personal data will be forwarded to third parties, with the exception of service partners who are dependent on the data for processing the order, like outside payment service providers (e.g. PayPal) and parcel services (DHL, UPS). However, the amount of data transmitted is limited to the required minimum.
We store and use your data only as long as this is necessary to perform our contractual or statutory duties or to fulfil those purposes for which the data were collected. Following expiry of the statutory periods of limitation, however, we restrict such processing, i.e. your data will be then used only to comply with statutory duties (e.g. duties of storage under tax and commercial law with regard to order and payment data). In this case we have a duty to store these data for up to ten years in our system.
‹BATAILLE NEWS› If explicitly requested by the customer, we will use the e-mail address for sending the newsletter (‘Bataille News’). So, if you voluntarily register to receive Bataille News, we will use your e-mail address for this purpose. For ordering Bataille News, we use the double opt-in procedure, since we must be able to certify that you are actually the holder of the e-mail address provided. This means, once your e-mail address has been provided, that we shall send you a confirmation e-mail to the e-mail address stated, in which we shall ask you to confirm your e-mail address. You can unsubscribe from the newsletter at any time using the unsubscribe link at the end of each newsletter. Alternatively, you can also send us an e-mail to firstname.lastname@example.org.
